In a landmark legal victory for Adron Homes and Properties Limited, the Federal High Court in Abeokuta, Ogun State, has dismissed a fundamental rights enforcement suit filed by the Registered Trustees of the City of David Residents Association (CODRA) and five other individuals — Elder Gbadebo Aromolaran, Mr. Adetokunbo Adeshile, Mr. Olaolu Ayinde, Olusegun Aba Yomi Esq, and Oluwadamilare Awokoya Esq.
The case, Suit No. FHC/AB/FHR/58/2023, was presided over by Hon. Justice Abiodun J. Adeyemi, who, after a detailed review of all claims and evidence, ruled that the Applicants’ allegations were unsubstantiated, speculative, and without merit.
Allegations Found to Lack Credible Evidence
The Applicants had accused Adron Homes of infringing on their right to personal liberty. However, the court found no credible evidence linking the company to any action or threat that could amount to a breach of their fundamental human rights.
Justice Adeyemi emphasized that there was no record of arrest, invitation, or harassment traceable to Adron Homes, making the allegations purely speculative.
Freedom of Association and Estate Management Rights
On the issue of proscription and alleged infringement of freedom of association, the court ruled that Adron Homes has no legal power to proscribe CODRA or stop residents from forming associations. However, the judgment clarified that while residents are free to associate, the exclusive legal right to own, manage, and administer the estate remains with Adron Homes as the legitimate developer and manager.
Justice Adeyemi noted that the decision was based solely on evidence and the rule of law, not conjecture or sentiment. Consequently, the case was dismissed in its entirety.
